Over the last 15 years Scott King of Gadsden, Alabama amassed the largest known collection of toenail and sunfish knives. The collection included excellent exemplars of 188 toenails, dozens in investment grade condition, and features over 80 different brands/makes including C. Platts, early Case, Case Brothers, NYKC, Napanoch, Pine Knot, Honk Falls, Union, Robeson, Cattaraugus Cutlery Co., and Miller Bros etc. 286 lots of knives, catalogs, displays, boxes, advertisements, billheads and reference books sold to the highest bidders regardless of price.

By participating in this auction the bidder agrees to the following terms and conditions:
  1. Disclaimer and Return Policy:
    All lots sell as is, where is, with all faults. McLemore Auction Company, LLC and the seller do not give or make any type of guarantee or warranty regarding the lots to be sold, implied or otherwise. All statements in the auction catalog or on any other literature as to the authorship, age, origin, measurements, quality, scarcity, provenance, importance, condition, and historical relevance of the auction lots are qualified statements of opinion and are not a representation or warranty. McLemore Auction Company, LLC encourages all bidders to inspect auction lots in person before bidding. McLemore Auction Company, LLC is not responsible for incorrect listing information, if any. McLemore Auction Company, LLC has attempted to provide accurate descriptions of all auction lots, however, it is the bidder's responsibility to determine the condition and suitability of each lot. All sales are final. There are no returns, refunds, or adjustments, with the following exception: A knife found not to be as described (in other words a serious, detrimental flaw that we missed) is returnable if returned within three days upon prior approval of McLemore Auction Company, LLC. If the flaw is visible in the photos published in the auction catalog, however, the knife is NOT returnable even if the flaw is not mentioned in the description.
  2. No Reserves:
    Each lot will sell to the highest bidder without reserve.
  3. No Buybacks:
    All sellers are contractually prohibited from bidding on lots they have consigned to the auction.
  4. Buyer's Premium:
    A buyer's premium of ten percent (10%) of the high bid will be added to the high bid to determine the final sales price for the auction lot.
  5. Sales Tax:
    McLemore Auction Company, LLC will not collect sales tax on items in this auction.
  6. Payment:
    Payment in full is due at the conclusion of the auction. Payment may be made at McLemore Auction Company, LLC (470 Woodycrest Av, Nashville, TN). All bidders must pay for their purchases no later than Friday, November 22 at 4:00 PM CT.

    McLemore Auction Company, LLC accepts the following forms of payment:

    • Cash
    • Certified checks
    • Cashier's checks
    • Personal and company checks accompanied by an irrevocable bank letter of guarantee addressed to McLemore Auction Company, LLC
    • Wire Transfers (Please note: a $15 service fee will apply to all payments below $5,000 made via wire transfer. For wire transfer instructions, please email info@mclemoreauction.com)
    • Credit Cards (MasterCard, Visa, American Express and Discover) (Please note: McLemore Auction Company, LLC will only accept payment by credit card for invoices of $5,000 or less. Payment for invoices greater than $5,000 must be made via wire transfer or cashier's check. Real estate may not be paid for using a credit card.)
    Merchandise becomes the full responsibility of the bidder at time of payment and the bidder assumes all risk of loss and damage to property at that time. McLemore Auction Company, LLC reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the bidder will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.
  7. Inspection:
    All items in this auction are available for inspection at 470 Woodycrest Avenue Nashville, TN, 37210 according to the schedule below.

    Inspection Dates:
    All items in the auction will be available for inspection by appointment only. Appointments will be available on Monday, November 18 and Tuesday, November 19, 2013 between 9:00 AM and 4:00 PM CT. To schedule an appointment, please call 615-517-7675. No viewings will be allowed without an appointment.

  8. Pickup:
    All items, may be picked up from 470 Woodycrest Avenue Nashville, TN, 37210 once McLemore Auction Company, LLC has received and acknowledged payment in full. Bidders are responsible for rigging, loading, and moving all items purchased without assistance from McLemore Auction Company, LLC.

    Pickup Date:
    Monday, November 25th, 9:00 AM - 4:00 PM CT

    All items must be removed from the auction location by 4:00 PM CT on Monday, November 25th, 2013.

    Any items not removed by this time will be considered abandoned property. McLemore Auction Company, LLC reserves the right to resell the items and retain all sales proceeds as payment for accumulated, unpaid storage and handling.
  9. Shipping:

    Douglas Sipes at UPS Store #4687 at 718 Thompson Lane in Nashville, TN will provide shipping and pickup services for this auction. If you intend to have items shipped, please contact Mr. Sipes before the conclusion of the auction to make arrangements to have him pick up items from McLemore Auction Company, LLC as your designated agent. You may reach Mr. Sipes at (615) 301-5006 or store4687@theupsstore.com. You will make payment for all pickup and shipping costs directly to Mr. Sipes. Please contact him for a quote.

  10. Auction Ending:
    Beginning at the stated closing time, the auction software will conclude bidding for five lots each minute in catalog order with the following exception: if a bid is placed in the last five (5) minutes remaining for that auction lot, bidding for that lot will remain open for an additional five (5) minutes.
  11. Outbid Notification:
    Until the auction begins to close, the bidding software will notify bidders by email when they have been outbid. After that, bidders may find out if they have been outbid by clicking the "Review Bids" button at the bottom of each page. Items the bidder is no longer winning will be marked with a red indicator.
  12. Debt Collection and Interest Charges:
    The bidder agrees to pay all reasonable attorney fees and other costs incurred by McLemore Auction Company, LLC in its efforts to collect unpaid funds from the bidder. The bidder agrees that a fee of 2% of the outstanding balance per month be added to any unpaid balance due McLemore Auction Company, LLC. Any debt collection or dispute proceedings will be heard in Davidson County, Tennessee.
  13. Guaranty Agreement:
    By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to McLemore Auction Company, LLC of any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney's fee.
  14. Limitation of Liability:
    If, for any reason, McLemore Auction Company, LLC is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of McLemore Auction Company, LLC, if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser.
  15. Age Requirement:
    All bidders must be 18 years of age or older.
  16. Bidder Information and Security:
    All registration information the bidder provides to McLemore Auction Company, LLC shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders must notify McLemore Auction Company, LLC if they believe that their bidder number and password have been compromised.
